During the initial stages of an insurance claim, we provide technical support to the insured by developing historical and environmental information that will be used as the basis of an insurance claim, typically under a pre-1987 comprehensive general liability policy. The historical information typically includes property ownership and lessee records, facility features and operations, chemical and material use, hazardous substance release records, and regulatory compliance. The environmental information may include an evaluation of the timing of release(s), identification of source(s), characterizing the nature and extent of contamination, and evaluation of potential feasible cleanup alternatives and estimated costs for implementation.

Project Experience

On behalf of the insurance companies, we review technical information and regulatory background supporting the policyholder’s claim for coverage. Based on this review, we assess whether there is sufficient evidence to establish the nature and timing of release and when third-party damage occurred. Also, whether other parties in addition to the policyholder may have contributed to the environmental contamination and to what degree.
