Capital Industries, Inc. (Capital) has occupied Plants 1 through 5 at the Capital Property, located at
5801 3rd Avenue South in Seattle, Washington, since 1965 for metal fabrication and related work
(e.g., metal fabricating, painting). In 1989, a small quantity of trichloroethene degreasing solvent was spilled during a refilling operation at the hot-vapor solvent degreaser unit on the concrete floor at the south end of the area between Plants 3 and 4. Plant 2 was destroyed by fire in January 2004 and was reconstructed that year. Capital has conducted several subsurface investigations at and proximate to the Capital Property since 2003. Capital and the Washington State Department of Ecology entered into Agreed Order No. DE 5348 (Agreed Order) on January 24, 2008. Under the Agreed Order, the Capital Site is defined as the area where concentrations of constituents of concern (COCs) released from the Capital Property exceed regulatory cleanup levels. Capital is currently conducting a Remedial Investigation to determine the nature and extent of COCs and to collect sufficient information to enable development and evaluation of technically feasible cleanup alternatives in accordance with Sections 360 through 390 of Chapter 173-340 of the Washington Administrative Code.
